01Operator and agreement

ThinkAPI is operated by ThinkApiAI Inc (“we,” “us,” or “our”), located at 312 E 25th St, Cheyenne, WY 82001. These terms govern your use of the ThinkAPI website, account, API access, and related management services.

The Usage Policy, Supported Regions, and Service-Specific Terms form part of this agreement. You must actively accept these documents before registering or signing in. If you use the service for an organization, you confirm that you are authorized to bind that organization to this agreement.

A separately signed service agreement takes precedence for matters it expressly addresses. Service-Specific Terms take precedence over general terms for the relevant features. Nothing in this agreement excludes rights that cannot be waived under applicable law.

02Eligibility and account security

  • You must have legal capacity to enter into this agreement and meet the age, location, and entity requirements of the models you use. Account information must be accurate, and your email address must be able to receive service and security notices.
  • Protect your password and API keys, and authorize access only for trusted people. If you discover a compromise or unauthorized activity, promptly disable affected keys, change your password, and contact us.
  • You are responsible for managing authorized account use and its charges. If unauthorized usage is disputed, we will review relevant records and address the matter according to applicable law and each party’s responsibility.

03Services and upstream dependencies

ThinkAPI provides AI model API access and tools for managing keys, request records, usage, costs, and service status. Available models, features, service groups, and allowances depend on what is enabled for your account.

Models are provided by their respective third-party providers. ThinkAPI branding and access do not imply any official agency, partnership, or endorsement that has not been expressly disclosed. Use of each model must comply with its applicable policies.

04Pricing, balance, and billing disputes

Charges are calculated using the model, service group, metered items, and prices applicable when a request is made. Input, output, caching, and tool use may have different rates. Before paying, review the balance credit, amount due, currencies, exchange rate, and payment-method details shown in your order.

Your balance pays for use of this service and is not a bank deposit or investment product. Redemption credits, promotional credits, and rewards are subject to the relevant offer rules and should not be treated as cash or amounts you have paid.

For disputed charges, missing credits, or refund requests, contact support with the order number or request ID. Refund eligibility, amount, and method are determined by applicable law, conditions clearly disclosed at purchase, and verified usage records. Confirmed billing errors or duplicate charges will be corrected.

Future price changes apply to requests made after they take effect and do not change the agreed prices of completed requests. New requests may be declined when credit or allowances are exhausted or payment issues arise. Verified charges already incurred remain payable.

05Inputs, outputs, and intellectual property

You must have the rights, permissions, and lawful basis needed to submit inputs. You retain your rights in inputs; rights in and permitted uses of outputs depend on applicable law and the relevant model terms. Providing routing and management services does not give us ownership of your inputs or outputs.

You authorize us to process relevant content as necessary to fulfill requests, bill usage, investigate faults, protect security, and meet legal obligations, and to transmit requests to providers needed for the feature. Rights in platform software, design, and branding belong to their respective owners.

Outputs may be inaccurate, incomplete, or similar to other users’ outputs. Verify them before publishing, executing, or relying on them, and arrange appropriate professional and human review for matters affecting individual rights, health, law, finance, or other significant decisions.

06Account information and request data

Operating the service involves account and contact information, access and security records, usage and payment records, and support content you submit. Requests are processed through ThinkAPI and relevant upstream services; logging configuration and troubleshooting may also involve request or response bodies.

Submit only information necessary for your task that you are entitled to process, and remove passwords, keys, and unrelated personal information where possible. API parameters, a provider’s marketing, or a console display do not by themselves establish a promise of zero retention, storage in a specific region, or industry certification.

Contact support to request access to, correction of, or deletion of account-related information, or to discuss processing locations, retention requirements, or an enterprise data-processing agreement. We will verify identity and handle requests according to applicable law. Transaction or security records legally required to be retained may remain after account closure.

07Availability and responsibility

We will maintain the service with reasonable care, but networks, maintenance, capacity limits, provider failures, and model changes may affect requests. Unless a written service-level agreement provides otherwise, public status and historical success rates are observations rather than commitments to a specific availability, response time, or service credit.

Each party is responsible under applicable law for its breach or fault. We are not liable for unforeseeable indirect losses to the extent the law permits such exclusion. These terms do not limit liability for fraud, intentional misconduct, gross negligence, or any matter for which liability cannot legally be limited.

08Suspension, termination, and review

You may stop using the service and request account closure through support. We may restrict requests, disable keys, or suspend accounts when necessary for violations, security threats, payment issues, or legal and provider requirements. Where feasible and legally permitted, we will explain the reason and available remedies.

If you believe an action was mistaken, request a review with relevant request IDs, time ranges, and necessary redacted evidence. Termination does not automatically remove existing payment obligations or statutory refund rights. Remaining amounts are handled under the billing provisions and applicable law.

09Changes to these terms

Updated terms will identify their version and effective date. We will notify you of material changes to your rights or obligations through service notices, email, or a sign-in prompt, with advance notice and renewed acceptance where required by law. Legal, security, or mandatory provider requirements may require immediate feature changes.

A new version does not retroactively change transaction conditions that applied to earlier requests. If you do not accept an update, you may stop using the service and contact support about your account and outstanding amounts.

10Applicable law and disputes

Subject to mandatory laws and consumer protections applicable to you, this agreement is governed by Wyoming law and applicable United States federal law. Disputes may first be raised through support; if unresolved, either party may seek relief in a court having jurisdiction under applicable law.

If a provision is held invalid, the remaining provisions continue to apply. The Chinese and English versions are intended to have the same meaning. Differences will be interpreted in accordance with applicable law and this agreement’s purpose, without reducing mandatory rights through translation differences.
